Nebenkosten are housing-related ancillary costs that a tenant usually pays in advance together with the Kaltmiete. After the accounting period ends, the landlord prepares a Nebenkostenabrechnung: they compare the building’s actual costs with your Vorauszahlungen and either charge an additional payment or refund an overpayment.

For a tenant, it is important not just to see the final amount, but to understand three things: which costs can actually be passed on to the tenant, which allocation key was used, and whether the annual statement arrived on time. These are the points where mistakes most often appear.

Kaltmiete, Warmmiete, and Nebenkosten

A German rental contract usually contains several amounts:

  • Kaltmiete: rent without utility and operating costs;
  • Nebenkosten / Betriebskosten: costs for maintaining the building and ongoing services;
  • Vorauszahlung: the monthly advance payment for Nebenkosten;
  • Warmmiete: the total monthly amount, meaning the Kaltmiete plus the Nebenkosten advance.

The owner or the Hausverwaltung pays the invoices from utility providers and service companies: heating, water, cleaning, the elevator, garbage collection, building insurance, and other permitted items. These costs are then allocated among the apartments.

National averages are only useful as a rough reference point. The actual bill depends on the building, heating system, municipal charges, floor area, household composition, consumption habits, and the rental contract.

How costs are allocated between apartments

The key term in a Nebenkostenabrechnung is Verteilerschlüssel, meaning the allocation key. It shows how the building’s total costs are divided among the apartments.

If no separate key was agreed, section 556a BGB provides for allocation by living space unless the law or the contract requires otherwise. In practice, however, the same statement may use different keys at the same time: heating by meter readings, cleaning by floor area, and garbage by number of occupants.

What can be included in Nebenkosten

The permitted categories of Betriebskosten are listed in the Betriebskostenverordnung. The rental contract must also state that the tenant pays Betriebskosten or specific categories of costs.

Nebenkosten usually may include:

  • heating and hot water, including the operation of the heating system;
  • cold water and sewage;
  • garbage collection;
  • cleaning of the stairwell, street, and common areas;
  • lighting in common areas;
  • chimney sweep services;
  • the operating part of caretaker work;
  • garden and grounds maintenance;
  • property tax;
  • building insurance, meaning Gebäudeversicherung;
  • elevator operation, including maintenance and inspections;
  • meter rental and maintenance, meter readings, and preparation of statements.

If the building has a shared boiler room, gas or other fuel costs are usually part of the utility statement. If the apartment has an individual contract with a provider, the tenant often pays for gas directly. Electricity in Germany for the apartment is usually not included in Nebenkosten: the tenant chooses the provider independently and falls into Grundversorgung if they do nothing.

What cannot be passed on to the tenant

Costs for managing, repairing, or financing the property must not appear disguised as utility charges. The following generally do not count as Nebenkosten:

  • Hausverwaltung and administrative management;
  • repairs, modernization, replacement of pipes, the boiler, the elevator, or the roof;
  • contributions to a repair reserve fund;
  • bank fees and interest on the owner’s loans;
  • the landlord’s court and lawyer costs;
  • the owner’s private insurance policies unrelated to the building itself;
  • one-off work after construction or major renovation.

If a Hausmeister line mixes cleaning, minor upkeep, and repairs, it is worth asking for a detailed breakdown. Operating services can be passed on, but the repair and administrative part cannot.

Cable TV and CO2: two lines worth checking especially carefully

Since July 1, 2024, the old Nebenkostenprivileg for cable TV no longer applies: the classic fee for a shared cable TV Anschluss can no longer automatically be allocated to all tenants through Nebenkosten. If this line still appears in the statement as an old subscription fee, it should be checked.

At the same time, some buildings may still have costs for operating a shared antenna or the building’s internal network. These cannot automatically be treated as the old cable subscription fee: look at the wording, the legal basis, and the contract.

For heating based on gas, heating oil, and other fossil fuels, the CO2-Kosten line matters. Under the CO2KostAufG, these costs are split between the landlord and the tenant; the owner’s share depends on the building’s energy condition. In an ordinary residential tenancy, CO2 costs cannot be passed on fully to the tenant. If the tenant buys fuel or heat directly, they often have to claim reimbursement of the owner’s share separately.

When the Nebenkostenabrechnung arrives

Under section 556 BGB, the landlord must provide the annual statement no later than 12 months after the end of the accounting period. If the period matches the calendar year, the statement for 2025 must arrive by December 31, 2026. If the accounting period runs, for example, from June 1 to May 31, the deadline is counted from May 31.

The consequences are as follows:

  • if the statement arrives late and shows an additional payment, the landlord usually loses the right to claim that payment;
  • if the statement shows an overpayment, it must be refunded even if the Abrechnung arrived late;
  • the tenant can raise objections within 12 months after receiving the statement.

If you move out in the middle of the year, there is usually no separate immediate statement. Your share is included in the building’s overall accounting period only for the months you lived there. The landlord may temporarily keep a reasonable portion of the deposit against an expected additional payment, but they must not hold the entire deposit indefinitely without a reason.

How to check a Nebenkostenabrechnung

Start with a formal check:

  1. Is the accounting period stated?
  2. Does the occupancy period match your share?
  3. Is the total amount for the building shown along with your share?
  4. Is the Verteilerschlüssel shown for each line?
  5. Have the Vorauszahlungen you already made been deducted?
  6. Were refunds, discounts, or corrections omitted?
  7. Are repairs, property management, or the old cable subscription fee included?

If the figures are unclear, request Belegeinsicht, meaning access to invoices, receipts, meter readings, and supplier calculations. In many cases, the documents can be sent or viewed electronically, but the procedure depends on the landlord and the Hausverwaltung.

How to object to a mistake

If you find an error after checking the statement, send the landlord a Widerspruch. In the letter, state which lines you dispute and why:

  • the item relates to repairs or modernization;
  • the allocation key does not match the contract;
  • supporting documents are missing;
  • the statement was issued after the 12-month deadline;
  • cable fees or CO2 costs are listed without a clear basis;
  • the amount of your advance payments was taken into account incorrectly.

You can pay the additional amount unter Vorbehalt, meaning subject to later refund after review, if you want to avoid a conflict over late payment. For important letters, it is practical to use Einwurf-Einschreiben or another method that confirms delivery.

If the disputed amount is large and the landlord does not respond on the substance, it may make sense to contact a Mieterverein or a lawyer specializing in Mietrecht. Before going to court, it is worth weighing the economics of the dispute: sometimes a consultation costs less than a long exchange of letters, and sometimes the amount in dispute is smaller than the future costs.

How to reduce future Nebenkosten

Heating, hot water, and the building’s energy efficiency usually have the biggest impact on the final bill. A tenant cannot fully control utility costs, but they can reduce the risk of extra charges.

Heating

  • Keep living rooms at around 19-21 C and the bedroom at about 17-18 C.
  • Do not switch the heating off for long periods in freezing weather: walls that get too cold increase the risk of dampness and mold.
  • Ventilate briefly and intensely rather than leaving a window tilted open all the time.
  • Do not cover radiators with furniture or heavy curtains.
  • Before renting, check the property’s energy certificate, especially if the building is old.

Because part of the heating cost is fixed, even a very frugal tenant will not reduce the bill to zero. But consumption still matters, especially in buildings with properly functioning meters.

Water

According to the Umweltbundesamt, a person in Germany uses an average of around 126 liters of drinking water per day. This is not a limit or a norm for a specific household, just a benchmark to understand the scale.

  • A shower is usually cheaper than a bath, especially with a water-saving shower head.
  • Run the dishwasher and washing machine only with a full load.
  • Fix leaks quickly: a dripping tap or toilet cistern can easily turn into extra cubic meters.
  • If hot water comes through the building’s central system, saving water reduces two lines at once: water and heating.

Tax return

Some expenses from the Nebenkostenabrechnung may be useful when filing a tax return. This is usually not about water or heating consumption, but about the separately stated labor portion of services: cleaning, gardening, winter maintenance, chimney sweep services, and some caretaker or service company work.

Under section 35a EStG, tax deductions apply to haushaltsnahe Dienstleistungen and Handwerkerleistungen within the statutory limits. To use them, ask the landlord or the Hausverwaltung for a breakdown that separately shows the Arbeitskosten. Materials, energy, Grundsteuer, and normal utility consumption do not fall under these expenses.

Short conclusion

In Germany, Nebenkosten should be read not as one number but as a set of lines with different rules. Check whether each cost is allowed, which allocation key was used, whether the deadlines were met, and whether supporting documents exist. If the statement is clear and arrived on time, an additional payment is usually lawful. If it includes repairs, the old cable subscription fee, an incorrect CO2 allocation, or an unclear Verteilerschlüssel, that is a reason to request Belegeinsicht and file a Widerspruch.
